DUI vs. DWI in Maryland

Maryland has two main impaired-driving offenses under Transportation Article § 21-902. Driving Under the Influence (DUI) is the more serious charge. It applies when a driver is under the influence of alcohol or has a blood alcohol concentration (BAC) of 0.08 or higher.

Driving While Impaired (DWI) is the lesser charge. It applies when alcohol has impaired a driver's normal coordination, even if the BAC is below 0.08. A BAC of 0.07 can be used as evidence of impairment.

  • DUI, first offense: up to 1 year in jail, up to a $1,000 fine, and 12 points on your license.
  • DUI, second offense: up to 2 years in jail and up to a $2,000 fine, with a mandatory minimum jail term.
  • DWI, first offense: up to 60 days in jail, up to a $500 fine, and 8 points.
  • Penalties increase when a minor is in the vehicle, and for third and later offenses.
